Legal basis
Basis: BEEG §§ 15–16 (German Federal Parental Allowance and Parental Leave Act). Parental leave must be requested from the employer in writing: 7 weeks in advance for periods before the child's 3rd birthday, 13 weeks in advance for periods between the 3rd and 8th birthday. Maximum 36 months per child in total.

The legal frame under the BEEG
Under §15 BEEG each parent can take up to 36 months of Elternzeit per child; up to 24 of them can be deferred to the period before the child's eighth birthday. You must notify your employer in writing: seven weeks in advance for leave before the third birthday, thirteen weeks between the third and eighth (§16). From the notification — at the earliest eight weeks before the start — you enjoy protection against dismissal (§18). Working part-time during Elternzeit is allowed, usually between 15 and 30 hours per week.
Elterngeld versus ElterngeldPlus
Elterngeld is separate from Elternzeit: as a rule of thumb it replaces about 65 to 67 percent of your net income, between 300 and 1,800 euros per month, for up to twelve months plus two partner months. ElterngeldPlus halves the monthly amount and doubles the duration — useful if you work part-time. An income limit applies and the thresholds change regularly, so treat these figures as orientation only and confirm your case with the Elterngeldstelle or your Steuerberater.
